Welcome to Viscena. These Terms and Conditions ("Terms") govern your access to and use of the Viscena website and the purchase of products sold by Triple J Import Inc. By accessing this website or placing an order, you agree to be bound by these Terms.

2. Eligibility

By placing an order, you represent that you are at least 18 years old or have the permission and supervision of a parent or legal guardian.

3. Product Information

We strive to ensure that product descriptions, images, specifications, pricing, and availability are accurate. However, errors may occur.

We reserve the right to correct errors, update product information, change specifications, or cancel orders affected by incorrect information.

Product specifications, colors, components, and features may change without notice as part of ongoing product improvements.

4. Off-Road Use Only

Unless specifically stated otherwise, Viscena electric dirt bikes are intended for off-road use only.

Customers are responsible for understanding and complying with all applicable federal, state, and local laws regarding ownership, operation, transportation, registration, and use.

5. Pricing and Payment

All prices are listed in U.S. Dollars.

Product prices do not include shipping unless specifically stated.

Taxes, shipping charges, and other applicable fees may be calculated separately during checkout.

Orders must be paid in full before shipment unless otherwise agreed in writing.

6. Order Acceptance

Submitting an order does not guarantee acceptance.

We reserve the right to refuse, limit, or cancel any order for reasons including suspected fraud, payment issues, pricing errors, inventory shortages, shipping restrictions, or other business reasons.

If payment has already been processed for a canceled order, a refund will be issued to the original payment method.

7. Shipping

Shipping is governed by our Shipping Policy.

Delivery timelines are estimates based on information reasonably available when an order is placed and are not guarantees of the carrier’s delivery date. If Viscena cannot ship within the timeframe stated at purchase, Viscena will provide the notice and remedies required by applicable law, which may include the option to consent to a revised shipping date or cancel the unshipped order for a full refund.

8. Returns and Refunds

Returns, cancellations, and refunds are governed by our Returns & Cancellations Policy.

9. Limited Warranty

Warranty coverage is governed exclusively by our Limited Warranty.

No other warranty, express or implied, applies unless required by law.

10. Assumption of Risk

Electric dirt bikes and powersports products involve inherent risks, including property damage, serious injury, or death.

By purchasing, assembling, operating, or allowing another person to operate a Viscena product, you acknowledge and assume all risks associated with its use.

Users are responsible for wearing appropriate protective gear, following all safety instructions, inspecting the product before use, and operating only in safe and lawful areas.

11. Age, Supervision, and Safe Operation

Viscena products are not toys.

Minors must be supervised by a responsible adult at all times.

The purchaser is responsible for determining whether a rider has the appropriate age, size, strength, skill, maturity, and judgment to operate the product safely.

12. Limitation of Liability

To the fullest extent permitted by law, Triple J Import Inc. shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from the purchase, ownership, assembly, operation, misuse, storage, transportation, or inability to use any product.

Our maximum liability shall not exceed the amount paid for the product giving rise to the claim.

13. User Responsibility

Customers are responsible for proper assembly, maintenance, charging, storage, inspection, and safe operation of all products.

Failure to follow the owner’s manual, warning labels, maintenance instructions, charging instructions, or safety guidelines may result in damage, injury, or voided warranty coverage.

14. Intellectual Property

All website content, including logos, product names, graphics, photographs, videos, product descriptions, and other materials, belongs to Triple J Import Inc. or its licensors and may not be copied, reproduced, distributed, modified, or used without prior written permission.

15. Prohibited Uses

You may not use this website or our products for unlawful, unsafe, abusive, fraudulent, or unauthorized purposes.

You may not interfere with website security, attempt unauthorized access, misuse checkout systems, submit false information, or engage in fraudulent transactions.

16. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles.

17. Dispute Resolution

Before filing any legal claim, both parties agree to first attempt to resolve the dispute through good-faith communication.

To the fullest extent permitted by law, disputes shall be handled on an individual basis and not as part of a class action, collective action, or representative proceeding.

Any dispute that cannot be resolved informally shall be brought in the appropriate state or federal courts located in Georgia, unless another forum is required by applicable law.

We may update these Terms from time to time.

Changes become effective when posted on our website.

Continued use of the website or purchase of products after changes are posted constitutes acceptance of the updated Terms.
